The prime suspect in the kidnapping of Madeleine McCann may end up avoiding charges due to a legal row between two prosecuting agencies.

Christian B may end up getting away with his alleged crimes scot free due to infighting between two German prosecuting agencies.

Prosecutors from the city of Braunschweig and the city of Magdeburg have been sparring over the 45-year-old monster’s alleged links to Madeleine and other child kidnapping cases.

The legal battle comes just days after Madeleine’s parents, Gerry and Kate, said on Friday, which would’ve been the kidnapped girl’s 20th birthday, that they refused to give up on her.

“We love you and we're waiting for you - we're never going to give up,” they said.

While Brauncschweig prosecutors have been leading the charge against the rapist, who is already behind bars for the rape of a US pensioner before Maddie’s 2007 abduction, German sources revealed to the Sun that Magdeburg may soon take over the case.

Magdeburg’s prosecutors have argued that the crimes took place on their patch, meaning they have a higher jurisdictional claim than Brauncschweig does.

The worrying move would give control to a prosecution office that has been much more focused on the hunt for Inga Gehricke, the missing girl who has been called “Germany’s Maddie.”

German sources now fear the move could doom the Madeleine case, especially since in April, a German court ruled that Braunschweig had no jurisdiction over the investigation. The fate of Braunschweig’s case last night lay in the hands of the Higher Regional Court based in Celle in Lower Saxony, according to the Sun.

Despite the massive uphill battle to keep the case, the city’s prosecutor Hans Christian Wolters remained confident that his team would be able to continue their work.

He told The Sun: “We will continue to investigate the Madeleine case and the accused will remain in custody.

“With regard to the decision of the Regional Court of Braunschweig on jurisdiction, we will first carefully examine the reasons.

“Then probably have the decision reviewed by the Higher Regional Court of Braunschweig.

“We continue to assume that we are responsible for a decision by the Higher Regional Court, so that the investigations into the Maddie case will continue as planned.

“In our view, there is currently no reason for speculation and a possible related abandonment of the proceedings.”

Christian B's lawyer, Friedrich Fulscher, denied using sneaky tactics and loopholes to get Maddie cops off his client's back.

"This is not an attempt to take away a case from the public prosecution office in Braunschweig,” he said.

"According to my examinations, (as confirmed by the Braunschweig district court), the public prosecution office of Braunschweig is simply not responsible for the jurisdiction here."
